Terms of Service - Lingather Live

Please read these Terms of Service ("Terms") carefully before using the Lingather browser extension and website (the "Service") operated by Rockhammer Labs LLC ("us", "we", or "our").

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

2. Subscriptions

Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis (such as monthly or annually).

An active Lingather Live Pro subscription covers supported platforms on the same account. Annual subscriptions receive their Online allowance in monthly releases, not as a full year of cloud minutes in advance. Unused Online minutes do not roll over.

3. Legacy Lifetime Purchases

Lingather Live no longer offers new Lifetime licenses. We continue to honor previously completed purchases for the product and platform scope stated in the original offer. Historical access is not converted into a recurring subscription, and any original Online allowance remains separate from subscription allowances.

Separately sold products, including Lingather Lens, may publish different product-specific purchase and update terms. A Lingather Live historical purchase does not include a separate product unless its original offer explicitly says so.

4. Processing Modes, Consent & Cloud Allowance

Local mode keeps raw audio on your device and does not upload it.

Online mode sends audio to Lingather's service and then to Alibaba Cloud's Singapore region only after your explicit authorization.

Before Online mode connects, you choose captions only or captions with voice-cloned translated speech. Voice-cloned output derives voice characteristics from the live audio and generates translated speech in addition to bilingual captions.

Free accounts receive a one-time 100-point Online trial after sign-in. Active Pro subscriptions receive 1,000 Online points per subscription month; unused points expire at the next monthly reset and do not roll over.

Metered Online cloud processing uses a metered point allowance shown in the product; it is not unlimited.

Lingather Lens media and OCR processing remain local to your hardware unless a Lens feature expressly presents a separate online disclosure and asks for your authorization.

5. Payment Providers

Website orders are processed by our online reseller Lemon Squeezy, which acts as Merchant of Record for those orders. Purchases made through a supported app store are processed and managed by that store. The applicable provider handles payment details, invoices, cancellation controls, and provider-side refunds for its transaction.

6. User Content

You are responsible for the audio content you process using Lingather. We do not claim ownership of your content, but you grant us a license to process it solely for the purpose of providing the transcription and translation service.

7. Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

8. Limitation of Liability

In no event shall Lingather be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.
